The filiation principle in acquiring Turkish nationality and the possible legal effects of termination of a filiation on the Turkish nationality

Abstract

This article analyzes the acquisition of Turkish nationality based on the filiation principle, according to the Turkish Nationality Law, and questions the possible legal effects of a subsequent termination of the filiation relationship, which constituted the legal basis for the acquisition of Turkish nationality. Within this framework, we presented the filiation principle in the acquisition of Turkish nationality and the retroactive effect of the termination of the filiation relationship between a parent and a child according to the Turkish Civil Code. In considering the effects of termination of the filiation relationship on nationality, we considered the provisions of the European Convention on Nationality, Swiss, and French laws. Possible legal effects of a subsequent termination were further analyzed according to the provisions of the Turkish Nationality Law and the views of the legal doctrine. In conclusion, we assert that a person shall maintain his/her Turkish nationality despite the subsequent termination of filiation, and an explanatory provision to this effect shall be inserted into the relevant legislation in order to guarantee legal certainty. / Bu çalışma kapsamında, Türk vatandaşlık hukuku uyarınca soybağı esasıyla vatandaşlık kazanılması ve Türk vatandaşlığının kazanılmasına temel teşkil eden soybağı ilişkisinin sonradan ortadan kalkması halinde, soybağı üzerindeki bu değişikliğin Türk vatandaşlığı açısından olası hukuki sonuçları incelenmiştir. Bu çerçevede, Türk vatandaşlığının kazanılmasında soybağı esası ve Türk Medeni Kanunu uyarınca soybağının ortadan kalkmasının geçmişe dönük etkisi ortaya konulmuş, Avrupa Vatandaşlık Sözleşmesi’nde, İsviçre ve Fransız hukuklarında bu mesele hakkında benimsenen çözümler aktarılmıştır. Konu Türk vatandaşlık hukukundaki mevcut düzenlemeler ve doktrinde yer alan görüşler uyarınca değerlendirilmiştir. Sonuç itibariyle, soybağının ortadan kalkmasına rağmen ilgilinin Türk vatandaşlığını muhafaza etmesi gerektiği ve hukuki öngörülebilirliği sağlamak adına bu yönde açıklayıcı bir düzenlemenin mevzuatımıza eklenmesi gerektiği belirtilmiştir.
