Introduction to non-life insurances regarding to the new Turkish commercial code

Abstract

On 13/1/2011, the new Turkish Commercial Code has been adopted under Nr. 6102. The Sixth Book of this Code contains the provisions on "insurance (contract) law" in two Chapters. The first Chapter sets out the "General Provisions" applicable to all insurance contracts, whereas the Second Chapter deals with "Particular Provisions" governing "non-life insurance" in the First Section and "life insurance" in the Second Section. The purpose of this paper is to provide a brief introduction to the legislative history of the new Code, followed by an outline of the new institutions and provisions in respect of "non-life insurance" contracts. In addition, consideration is given to the question as to how the new law of "non-life insurance" is affected by other recent legislation on insurance (regulatory) law and contracts law. /Öz: 3/1/2011 tarihinde, 6102 sayjl yeni Türk Ticaret Kanunu kabul edilmiştir. Bu Kanunun Altıncı Kitap'ında sigorta (sözleşmeleri) hukuku iki Kisim'da düzenlenmiştir. "Genel Hükümler"e ilişkin Birinci Kısım'ı, "Özel Hükümler"e ayrılan ikinci Kısım izlemektedir. "Özel Hükümler"in Birinci Bölüm'ü de "zarar sigortalarna ayrılmıştır. Bu qahmada, yeni Kanun'un hazırlık sureci hakkında özet bilgi sunulması, ardından zarar sigortaları hakkında kabul edilen kuralların ve yeniliklerin tanıtılması amaçlanmıştır. Ayrıca, diger bazı yeni kanunların "zarar sigortalarina etkileri üzerinde durulmuştur.
