    50 years after the labour recruitment agreement with Germany: the consequences of emigration for Turkey

    Turkey is a country with relatively recent and ongoing experience of labour emigration. Starting with the signing of the bilateral Turkish-West German labour recruitment agreement in October 1961, it has been a country of emigration, a trend that significantly influenced part of its economic, social, and political history. This essay elaborates the last fifty-year history of labour emigration from Turkey, and its consequences for the country in the economic, social and political spheres. It aims to sketch briefly the trends and patterns of emigration flows with reference mainly to the changing nature of these flows over time. More specifically, the essay offers an overview of the main impacts of labour migration for the country. It concludes that neither the positive nor the negative consequences of emigratory flows for the country should be overestimated.

Ancak bu ihtilafların tahkime elverişliliği, şirketler hukukunun esassözleşmesel tahkim şartına cevaz verip vermediği ve yargılama usulünün bu davalardaözellik arz etmesi konuyu tartışmalı kılmaktadır. Bu çalışmada tüm bu tartışmalımeseleler karşılaştırmalı hukuktaki gelişmeler de dikkate alınarak incelenmiş ve konuhakkındaki hukuki belirsizlikleri gidermek üzere öneriler sunulmuştur.

    Zusammenfassung Das Gesetz fuer geistige Schoepfungen und Kunstwerke trat im Jahre 1951 in Kraft. Es bestimmt den Schutzgegenstand des Urheberrechts und stellt verschiedene Kategorien,wie wissenschaftliche und literarische Werke,musikalische Werke, Kunstwerke und Filmwerke auf. Seit der Gesetzesaenderung im Jahre 1995 werden auch verwandte Schutzrechte des ausuebenden Kuenstlers,des Herstellers von Tontraegern und des Sendeunternehmens anerkannt Der Schutz der Verwertungsrechte und der urheberlichen Persoenlichkeitsrechte bildet Den Kernpunkt dieses Rechtsbereiches. Der einstweilige Rechtschutz spielt im Urheberrecht eine kritische Rolle. Die Einfuehrung der Berufungsinstanz ist aus diesem Grund zu begruessen, da die Gerichtspraxis in Vergangenheit zur Abweisung der Antraege tendierte. / Abstract The Turkish Copyright Act is from 1951. This Act distinguishes between several classes of works such as linguistic works, musical works, works of arts and cinematographic works. Under the amendment in 1995 the same. Act is regulating the related rights: The protection of the rights of exploitation and moral rights is a sensitive subject for legal practice. Furthermore, the protection of copyrights is related with preliminary injunctions. The provisional legal protection of copyrights can be safeguarded by the new built. Courts of appeal in Turkey. / Öz (Türk) Fikir ve Sanat Eserleri Kanunu 1951 tarihlidir. Söz konusu kanun birçok eser kategorisine yer vermektedir; bunlar sırasıyla edebiyat eserleri, müzik eserleri, güzel sanat eserleri ve sinema eserleridir. 1995 değişikliği ile aynı kanun eser ile bağlantılı hakları da koruma altına almıştır. Uygulamada eser üzerindeki mali haklar ile manevi yetkilerin hukuki korunmas hassas bir konudur. Bunun yanı sıra telif haklarının korunması ihtiyati tedbirler ile de bağlantılıdır. Fikri hakların geçici korunması yeni kurulan istinaf mahkemeleri ile de garanti altına alınmıştır.

    Integration and/or transnationalism? the case of Turkish-German transnational space

    This article is derived from the findings of an empirical study based on semi-structured and life course qualitative interviews conducted with Turkish-German migrants and their significant others in both countries.1 As the interviews involved different migrant categories, migrants’ life courses and different areas of action, the findings show a large variety of transnational contacts, activities and orientations. After explaining the methodology and the data, the article introduces a typology of transnationalism reflecting these varieties, which is followed by the argument that there is a positive, concurrent and mutually beneficial, relationship between transnationalism and integration.

    As the Turkish state’s position on the issue of international migration is being transformed, new questions have arisen about the state’s policies on immigration and emigration. These are two issues that have long been seen as separate in migration literature. The aim of this article is to unite these two issues in order to present a retrospective on the Turkish state’s responses to the realities of immigration and emigration. We describe the migration patterns in Turkey by focusing on four key periods: a) the two-way immigration and emigration circulation in the early period of modern Turkey; b) the emigration boom since the 1950s; c) the emergence of new migration patterns in the 1980s; and d) the new forms of migration governance employed since the 2000s. By examining these patterns and the state’s responses, we aim to analyse the diverging political rationalities of different periods.

    On the globalization, wealth inequality and democracy triangle

    Scholars interested in problems of inequality are paying increasing attention to the issue of wealth inequality. The paper attempts to provide a broad picture of trends relating to wealth inequality on a global scale. It attempts to highlight the negative implications of rising wealth inequality for the future of just globalization and democratic development. One of the main findings of the paper is that wealth inequality is an equally serious problem for the "global North" and the "global South". Within the global North, wealth inequality is most serious for the case of the United States, whilst in the context of the global South, China constitutes a clear outlier, with a relatively favorable pattern in terms of wealth inequality. Finally Turkey has experienced serious increases in wealth inequality in recent years and currently occupies the second position in the wealth inequality league table next to Russia, a negative development, requires serious re-thinking about Turkey's current development strategy. / Bu çalışmanın amacı, ekonomik eşitsizlik araştırmalarında giderek daha çok ilgi çekmeye başlayan servet eşitsizliği olgusuna dair güncel verileri değerlendirmek ve bu olgunun küreselleşmeye ve demokrasinin geleceğine yönelik olumsuz etki ve yansımalarını tartışmaktır. Servet eşitsizliği sorununun gelişmiş “küresel kuzey” ve yükselen “küresel güney” ülkelerinin ortak sorunu olduğu çalışmamızda açıkça vurgulanmaktadır. Gelişmiş ülkeler düzeyinde servet eşitsizliğinin, özellikle ABD bağlamında, çok ciddi boyutlara ulaşması, yükselen ülkeler açısından da Çin'in diğer BRICS ülkelerine göre daha iyi bir konumda olması dikkat çekici bulgular arasında yer almaktadır. Türkiye'nin, Rusya ile birlikte, servet eşitsizliği sorununun en yüksek seviyelerde yaşanan ülkeler arasında yer alması özellikle üzerinde düşünülmesi gereken kaygı verici diğer bir gelişme olarak nitelendirilebilir.

    Political culture: a tale of two civilizations

    Whether we take the Tanzimat Edict of 1839 as the symbolic milestone marking the start of the Turkish/Ottoman Westernization efforts, or we prefer even earlier events such as Vakayi Hayriye or even the short-lived Tulip Era, contemporary Turkey's political culture has been shaped by the never-ending struggle between two different mindsets and identities. Recent years, however, have witnessed serious levels of political polarization which is closely correlated with the deeply-rooted cultural schism. The present chapter aims at describing and analyzing the main dimensions of contemporary Turkish political culture against this historical background. Special attention is devoted to the prevalence of democratic values as measured by surveys conducted over the last three decades.

    The historical development of populism in turkey in the light of populism theories: an analysis on political parties

    This article evaluates how and which political parties adopted populist notions from the late Ottoman Empire to contemporary Turkish politics. As such, our study considers populism as a thin-centered ideology. In the light of this definition, which allows broadening the scope for observational research,we examined the history of populism in Turkey along with the concepts of the people, the elites, and the people’s will. Our review puts forward three distinct concepts of “people” in populism in Turkey. These conceptualizations cover “the ordinary people” of the Republican People’s Party (Cumhuriyet Halk Partisi-CHP) during the 1970s on the left, “the will of the people” and “commonsense of the people” adopted by the center-right parties since the 1950s, and “Islamic people” embraced by the National Outlook (Milli Görüş) on the right since 1969. The definition of elites positioned against the people in Turkey varies depending on whether political parties are in power and where they fall on the ideological right-left spectrum. In the recent period, the Justice and Development Party (Adalet ve Kalkınma Partisi-AK Parti) has brought a new identity to Turkish populism by blending the lines of the Democrat Party (Demokrat Parti-DP) and Justice Party (Adalet Partisi-AP) and the approach of National Outlook. In this context, the definition of the elite against the people ranges from exclusive-authoritarian rulers in domestic politics to external enemies in international politics and their domestic collaborators. Overall, our historical analysis demonstrates that populist notions in Turkey is not restricted to a single political party or ideology. Such a historical analysis will provide a significant resource for further quantitative and qualitative analyses. We also anticipate that putting forward the development of populism over time and across the left-right ideological spectrum in Turkey will theoretically as well as empirically contribute to other comparative studies. / Öz: Bu çalışma, popülist eğilimlerin Osmanlı İmparatorluğu’nun son döneminden günümüz Türkiye siyasetine kadar hangi liderler ve partiler tarafından ne şekilde benimsendiğini araştırmaktadır. Bu amaçla çalışmamızın kurgusu popülizmi zayıf-merkezli bir ideoloji olarak kabul etmektedir. Görgül zenginliğe olanak sağlayan bu tanımlamanın ışığında Türkiye’deki popülizmin tarihi millet (halk), elitler ve milli irade kavramlarıçerçevesinde irdelenmiştir. İncelememiz Türkiye’deki popülizmde üç ayrı “halk” kavramını gözlemlemektedir. Bunlar, solda 1970’ler Cumhuriyet Halk Partisi’nin benimsediği “sıradan insanlar;” merkez sağ partilerin 1950’lerden itibaren takip ettiği “milli irade” ile “halkın aklıselimi” ve sağda 1969 itibariyle Milli Görüş ideolojisinin benimsediği “İslam milleti” tanımlamalarıdır. Türkiye’deki popülizm, milletin (halkın) karşısına yerleştirilen elitlerin tanımına siyasal partilerin muhalefette-iktidarda olup olmamalarına ve ideolojik sağ-sol yönelimlerine göre farklılık göstermektedir. Yakın dönemde ise Adalet ve Kalkınma Partisi, Demokrat Parti ve Adalet Partisi çizgisini ve Milli Görüş’ün yaklaşımını harmanlayarak Türkiye popülizmine yeni bir kimlik kazandırmıştır. Bu bağlamda, milletin (halkın) karşısındaki elit tanımı iç siyasetteki dışlayıcı-otoriter yöneticilerden uluslararası siyasetteki dış düşmanlara ve onların iç siyasetteki işbirlikçilerine endekslenmiştir. Sonuçta, incelememiz Türkiye’deki popülist eğilimlerin siyasette sadece belli bir parti ve ideolojiye ait olmadığını tarihsel bir bütünlük içerisinde sunmaktadır. Bu teorik temelli tarihsel bütünlük aynı zamanda diğer nicel ve nitel vaka analizlerine de önemli bir kaynak sağlayacaktır. Millet (halk), elitler ve milli irade kavramlarının tarih içerisinde ve siyasal sağ-sol ideoloji yelpazesinin neredeyse her yerinde geçirmiş olduğu gelişimi ortaya koymanın diğer karşılaştırmalı çalışmalara da hem kuramsal hem de görgül katkılarda bulunacağını düşünmekteyiz.
