dc.description.abstractThe provisions of French appeal by the court of cassation, due to the presence of the three-stage system are quite ahead of the Turkish law. A three-stage system has been foreseen in the current code of civil procedure, on the other hand, the two stage system is still in operation and the court of cassation continues to appeal as court of appeal. The current situation does not comply with the legal order and the rationale of the Act no.6100 in accordance with the right to legal remedies. Courts of appeal should be made fully operational as soon as possible. It would be meaningless and nonfunctional to establish additional chambers to court of cassation, whenever the courts of appeal become operative.
dc.description.abstractFransız hukukundaki temyiz hükümleri, üç aşamalı sistemin varlığı sebebiyle Türk hukukundan oldukça ileridedir. Mevcut kanunumuzda üç dereceli bir sistem öngörülmüş olsa da, halen iki dereceli sistem uygulanmaktadır ve istinaf görevini temyiz mahkemesi görmeye devam etmektedir. Mevcut durum, yasal düzene uymamakta ve 6100 sayılı Kanun'un gerekçesi uyarınca "hak arama hürriyetinin yeterince gerçekleştirilmiş sayılması için zorunlu görülen" istinaf derecesinden bireyleri mahrum bırakmaktadır. îstinaf mahkemeleri bir an önce işler hale getirilmelidir. Belirtmek gerekir ki, istinaf mahkemelerinin kurulması halinde Yargıtay'a ilave daire kurmanın bir anlamı ve işlevi de kalmayacaktır.
