Scope and content of the acton Health and Safety at Work

Abstract

Law No. 6331 concerning Health and Safety at Work entered into force as of January 1st, 2013. Te scope of the law is initially limited to workplaces, where fifty or more workers are employed. Te law in question has abandoned the term “employee”, which is a basic concept in Turkish labor law and instead embraces a new concept, i.e. “worker”, with the objective of including as many people as possible within its scope. However the current number of administrative staf at the Ministry of Labor and Social Security seems to be inadequate to inspect such a large number of people falling into the scope of application.

6331 sayılı İş Sağlığı ve Güvenliği Kanunu, 1 Ocak 2013 tarihinden itibaren ilk aşamada elli ve daha çok sayıda çalışanın bulunduğu işyerlerinde geçerliolmak üzere, yürürlüğe girmiştir. Söz konusu yasa, Türk iş hukukundaki işçi(employee) kavramını terkedip, çalışan (worker) deyimini kabul etmekte veyaklaşık herkesi kapsamına almayı amaçlamaktadır. Ancak, Çalışma ve SosyalGüvenlik Bakanlığının mevcut denetim kadrosunun, böylesine geniş bir uygulama alanını denetim altında tutabilmesi son derece güç görünmektedir.
