Crimes committed through breach of the duties of protection, supervision, assistance and notification in the Turkish Penal Code

Abstract

The crimes laid down in Articles 97 and 98 of the Turkish Penal Code (Law no. 5237) have been analyzed in the article. With regard to the crime of abandonment laid down in Art. 97 TPC, the meaning of terms in the statutory definition of the crimes such as age , illness , situation in which he can not care for himself have been explained, the concept abandon by himself which constitutes the material element of the crime and the scope of the moral element have been analyzed, under the heading aggregation , similarities and differences with similar crimes have been exposed. With regard to the crime of Failure in the Duty of Assistance or Notification , the status of the perpetrator and the victim, the meaning of failure to assist , the scope of the danger and duty of assistance required have been studied, and under the headingaggregation , the relationship between this crime and the crimes of homicide and wounding has been analyzed. / Makalede, 5237 sayılı Türk Ceza Kanununun 97. ve 98. maddelerinde düzenlenmis bulunan suç tipleri ele alınmıstır. TCK m. 97de yer alan terk suçu bakımından, suçun kanuni tanımından yer alan,yas , hastalık , kendini idare edemeyecek durum gibi kavramların anlamı açıklanmıs, suçun maddi unsurunu teskil eden kendi haline terk kavramı irdelenmis, suçun manevi unsurunun kapsamı incelenmis, içtima baslığı altında, ise benzer suç tipleriyle benzerlik ve farklıklar ortaya konulmustur. TCK m. 98de düzenlenen yardım veya bildirim yükümlülüğünün yerine getirilmemesisuçu bakımından da, failin ve mağdurun statüsü, yardım etmeme nin anlamı, tehlikenin ve yardım yükümlülüğünün kapsamı incelenmis; içtima baslığı altında, bu suç tipi ile yaralama ve öldürme suçları arasındaki iliski ele alınmıstır.
